Local Congress Studies the Recognition of Nature Rights at the Constitutional Level
San Raymundo Jalpan, Oax. January 18, 2021.- Local Congress is studying an initiative to reform the Oaxaca Political Constitution to grant recognition and legal protection to the rights of nature, and thus establish an effective defense to the elements that make it up.
The proposal seeks to amend various parasites of Article 12 Constitutional, to recognize that nature is composed of its elements, ecosystems and biodiversity, and that it is part of the environment where life develops in all its expressions, including human and human biodiversity.
It provides that everyone within the territory of the State has the right to live in harmony with nature, and in case of possible environmental damage, state and municipal authorities in administrative and judicial matters, within their powers, shall act according to the precautionary principle.
It also details what the rights of nature are and who will have to guarantee them. It also sets out the State’s responsibilities for protecting, restoring, legal representation, promoting citizen and entrepreneurial participation, access to information and justice.
The above because the environment, within state territory, has suffered severe affectations in its ecological and vital cycles. Some cases have been the contamination of several tributaries such as the Atoyac and Salado rivers, in the Central Valleys, and Papaloapan, in the Basin region, among others.
Thus, the 64th Legislature analyzes the incorporation of international precepts recognizing the rights of nature, so that state authorities assume responsibility through the issuance of secondary laws, public policies and programmes, a sustainable use of environmental benefits that are offers nature.
The reform initiative was presented by Congressman Fredie Delfín Avenda ñoo and turned by the Management Table for study in the relevant commissions.

𝐄𝐬𝐭𝐮𝐝𝐢𝐚 𝐂𝐨𝐧𝐠𝐫𝐞𝐬𝐨 𝐋𝐨𝐜𝐚𝐥 𝐞𝐥 𝐫𝐞𝐜𝐨𝐧𝐨𝐜𝐢𝐦𝐢𝐞𝐧𝐭𝐨 𝐝𝐞 𝐥𝐨𝐬 𝐃𝐞𝐫𝐞𝐜𝐡𝐨𝐬 𝐝𝐞 𝐥𝐚 𝐍𝐚𝐭𝐮𝐫𝐚𝐥𝐞𝐳𝐚 𝐚 𝐧𝐢𝐯𝐞𝐥 𝐜𝐨𝐧𝐬𝐭𝐢𝐭𝐮𝐜𝐢𝐨𝐧𝐚𝐥
San Raymundo Jalpan, Oax. 18 de enero de 2021.- El Congreso Local estudia una iniciativa de reforma a la Constitución Política de Oaxaca para otorgar el reconocimiento y protección jurídica a los Derechos de la Naturaleza, y establecer de esta manera una defensa eficaz a los elementos que la conforman.
La propuesta busca modificar diversos párrafos del Artículo 12 Constitucional, para reconocer que la naturaleza está conformada por sus elementos, ecosistemas y biodiversidad, y que es parte del medio ambiente donde se desarrolla la vida en todas sus expresiones, incluida la humana y la biodiversidad.
Prevé que toda persona dentro del territorio del Estado, tiene derecho a vivir en armonía con la Naturaleza, y en caso de posibles daños ambientales, las autoridades estatales y municipales en materia administrativa y judicial, en el ámbito de sus competencias, deberán actuar conforme al principio precautorio.
Asimismo detalla cuáles son los Derechos de la Naturaleza y quienes deberán garantizarlos. Además establece las responsabilidades que tendrá el Estado hacia ella en materia de protección, restauración, representación legal, promoción de participación ciudadana y empresarial, el acceso a la información y a la justicia.
Lo anterior debido a que el medio ambiente, dentro del territorio estatal, ha sufrido graves afectaciones en sus ciclos ecológicos y vitales. Algunos casos han sido la contaminación de varios afluentes como los ríos Atoyac y Salado, en los Valles Centrales, y el Papaloapan, en la región de la Cuenca, entre otros.
De esta forma, la 64 Legislatura analiza la incorporación de preceptos internacionales que reconocen los Derechos de la Naturaleza, para que las autoridades estatales asuman responsabilidades mediante la expedición de leyes secundarias, políticas públicas y programas, un uso sustentable de los beneficios ambientales que ofrece la Naturaleza.
La iniciativa de reforma fue presentada por el congresista, Fredie Delfín Avendaño, y turnada por la Mesa Directiva para su estudio en las comisiones correspondientes.
